Sales and Contract Conditions
These Contracting Conditions regulate the use of the online store www.miijoya.com/en, whose legal responsibility is Atelier Creuset S.L. and tax number B01760396 hereinafter, MIIJOYA. These Conditions will be accepted by the parties without reservation, and may be modified at any time and without prior notice, so it will be the user’s responsibility to read them every time they make a purchase, since the conditions in force at the time of the contract , will be those that are applicable to you.
Applicable regulations
This electronic contract is concluded under Spanish regulations and specifically under the legal regime imposed by Law 34/2002 on Services of the Information Society and Electronic Commerce (LSSICE) and by General Law 03/2014 for Defense of Consumers and Users (LGDCU).
The electronic contract will not be filed by a third party and the language for its conclusion is Spanish. These general conditions may be stored and reproduced at any time by the user who makes a purchase through the options of their internet browser, and must be accepted before proceeding with the payment of the order.
User Account and Bug Fixes
In order to make purchases online in this store, you can register by creating a “User Account”, or make a quick purchase without registration (as a guest user).
If you make the purchase as a guest, the personal data will not be stored on the web, nor will the order history be verified. Personal data will be kept only for the management and delivery of the requested products.
If you decide to register, you will receive an email confirming that the process has been completed successfully and a reminder of the access data. From the account you will be able to make purchases, check the order history, change the password, modify the personal data, modify the shipping and billing addresses, make comments, and other procedures or procedures related to your purchases.

Purchasing process
The present information and details contained on this website do not constitute an offer to sell, but an invitation to do business. There will be no contract between the client and MIIJOYA in relation to any product until the order has been expressly accepted by MIIJOYA (even if it has already been charged to your account). If the offer is not accepted and a charge has already been made to your account, the amount of the offer will be fully refunded to the customer.
After confirming the order, you will receive an email acknowledging receipt of your order (Order Confirmation). It should be noted that this does not mean that your order has been accepted, since it constitutes a mere offer to MIIJOYA to buy one or more products. All orders are subject to acceptance by MIIJOYA, who will confirm such acceptance by sending an email informing that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between MIIJOYA and the customer (Contract) will be formalized only when the Shipping Confirmation with its corresponding invoice is sent to said customer.
Only those products related to the Shipping Confirmation will be the object of the Contract. MIIJOYA will not be obliged to supply any other product that may have been ordered by the customer until the shipment is confirmed in a separate Shipping Confirmation.
There may even be exceptional circumstances (in accordance with Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism that affects the jewelery sector) that oblige to reject the processing of any order after having Order confirmation sent. MIIJOYA reserves the right to do so at any time, in its sole discretion.
Shopping at MIIJOYA is easy and simple, you just have to follow the following steps:
1º.- Select the products you wish to purchase from those offered by MIIJOYA. Clicking on each product, you access its tab, which includes a detailed description with the information, main characteristics and price. If you need more information, don’t hesitate to ask us. NOTE: In the case of product sheets with photographs, the products may suffer slight variations in color or texture with respect to the photograph that appears on the web, due to different factors, for example, the resolution of your monitor. However, we will do our best to make the images as true to reality as possible.
2º.- Once you have selected the product / s you want to buy, you must press the “Add to your basket” button, and the product will be incorporated into your shopping basket. If you wish, you can continue adding more products to the basket, or proceed directly to payment.
3º.- Once the selection of products is concluded, a summary will appear identifying the selected article / s. Finally, to continue with your order, you must press the “Finish purchase” button.
4º.- As we have indicated in previous sections, at the end of your purchase, you have the option of doing so by registering, or making a quick purchase without registration (as a guest user). When registering, you must indicate your contact information and address, and on your next purchases you will not have to enter your information again.
5º.- Finally, you must accept these Conditions of Sale and choose the means of payment for your order from among those offered by MIIJOYA (see next section).
6º.- Once the contracting process is complete, we will send you an email detailing the details of the same, as well as proof of purchase or invoice. If you do not receive this email within 24 hours, or if you appreciate any error in the data entered, contact us by any of the following means:

MIIJOYA has various payment methods to facilitate your purchase:

Payment by credit or debit card is made through Stripe’s secure payment gateway. Through this payment method, MIIJOYA never collects or manipulates any customer data related to their card number. All data is processed directly by Stripe, so that MIIJOYA can always offer the greatest security, transparency and confidentiality in the transaction.
The cards that the payment gateway currently supports are Visa, Visa Electron, Maestro, Mastercard, American Express, DK and other international credit cards, in addition to those belonging to 4B, Red 6000 y Servired networks. Shipping
At the time of purchase depending on the destination you will be able to observe different terms and shipping methods. Regardless of the chosen modality, the product handling and preparation period is 24 business hours, starting with the shipping times indicated below it.
For shipments to Spain to peninsular territory, the shipment is made by courier service to the indicated address with hand delivery and notice to collect not being at the address or second delivery attempt depending on the courier used. Average shipping time is 24 business hours. Shipping costs are 4,85€ or free for purchases over 50€.
For shipments to the Balearic Islands it is also made by courier service at home. Average shipping time is 48-72 business hours. Shipping costs are 10€ or free for purchases over 100€.
For shipments to the Canary Islands, Ceuta and Melilla it is made by Correos. Average shipping time is 48-72 business hours. The costs are 30€, which already include the presentation and processing of the Customs Documents necessary for export.
In international shipments, the company that delivers will vary depending on each country. Not being MIIJOYA’s responsibility for non-compliance with delivery times.
For shipments to the European Union the average shipping time is 72 business hours. Shipping costs are 20€ or free for purchases over 100€.
For shipments to other countries it is made by certified mail to the indicated address. Hand delivery will depend on the postal service in the destination country. In these destinations we cannot offer an average delivery time as we depend on different postal services. Shipping costs are 55€ which already include the presentation and processing of the Customs Documents necessary for export.
In all cases you will receive an email to your email informing you that the order has already been completed and if you request it we will send you the shipping tracking number as well as a direct link to the courier company so you can check it at any time.
In some cases and depending on the availability of the product (stock disruption), our staff will contact you to give you a solution and to inform you of the delivery time once the selected product is available.
The courier company usually delivers during business hours, so if you have a time preference for delivery, you can indicate it to us in the comment of the order and it will try to comply (to the extent of the possibilities of route and schedule of the transport company ).
IMPORTANT: We are not responsible for the breach or delay of obligations due to causes beyond our control, such as in case of force majeure or fortuitous event. Although the majority of deliveries are made within the indicated period, occasionally, delays may occur due to data transcription errors, inclement weather, dates of high volume of orders, etc. In such a case, contact us to resolve the issue as soon as possible. In addition, compliance with deadlines also depends on third parties, so we are not responsible for strikes, closings, accidents or other causes of force majeure that prevent compliance with them.
Prices, taxes, fees and duties
Prices are expressed in Euros, and are valid except for typographical errors. In the event that there is a manifest error in setting the price that appears in the product sheet, the price established for said product will prevail in the informative email that we will provide you when we detect the error.
The prices on the website include 21% VAT by default but in the case of the Canary Islands, Ceuta and Melilla they will be updated and will be shown without VAT (and you will not be charged) once you have marked one of these destinations at the address of Shipping. Shipping costs are excluded in the prices of the WEB page, which will be added to the total amount due and will be indicated to the customer in a detailed manner on the final purchase page. Likewise, shipments to the Canary Islands, Ceuta and Melilla already include expenses for the management of the Customs Documents necessary for export.
For sales to third countries outside the European Union, the prices will be shown without VAT and the shipping costs have already included the costs for the management of the Customs Documents necessary for its export.
INFORMATION REGARDING CUSTOMS FOR SHIPMENTS TO THE CANARY ISLANDS, CEUTA, MELILLA AND INTERNATIONAL SHIPMENTS
In the event that the shipment is held at customs, the recipient will have to bear the handling costs. This option is accepted with the purchase. In those cases that the article has reached its destination and the client rejects the customs and management payment, this amount will be deducted from the return of the article.
In no case MIIJOYA is responsible for the payment of customs management or the taxes derived from them.
Returns
At MIIJOYA we wish satisfaction with your order. Therefore, we provide you with various methods to return an item that may not meet your needs or expectations. Possible cases of return or withdrawal:
- The product is wrong, has a defect or has been damaged during transport:
We pay great attention to that all our items and shipments are in perfect condition. If you receive an erroneous or defective article, contact us immediately through hola@miijoya.com. Before opening the product, verify that the packaging matches the one requested: color, size, finish, etc. In case of any anomaly, also make an immediate claim, before opening the seal or its packaging.
When the product has been damaged during transport, it is essential that you notify us the same day that you receive the merchandise and that you note the incidence on the delivery note of the carrier.
Products must be returned in a protected manner, including them in a protective box or bag. Contact us so that we can arrange the collection of the products through the email hola@miijoya.com. MIIJOYA will not accept any return received postage due.
- Withdrawal:
We don’t want you to keep anything you don’t like, so you can return an item if it doesn’t meet your expectations. Therefore, according to the provisions of the Consumer Defense Law, you have the Right of Withdrawal, by virtue of which you can return the product.
The exercise of this right of withdrawal will have to be carried out within a maximum period of 14 calendar days from its receipt. You must notify us, by email hola@miijoya.com, of your decision to withdraw from the purchase made (you can use the model withdrawal form that you can find by clicking here).
In order to exercise this right, the product must be in perfect condition and retain the original packaging, as well as all parts. In the event that the products do not arrive in perfect condition, MIIJOYA reserves the right to pay a lower amount in the return, a circumstance that will be notified to you.
The refund of the purchase amount will be made once the condition of the merchandise has been verified, through the same payment method used in the purchase and, in any case, in a maximum of 14 calendar days from the reliable receipt of the request for withdrawal, as long as it is MIIJOYA who manages the collection of the article. In the event that you return the item through a transport company of your choice, the period of 14 days will begin to count from the moment MIIJOYA has effective knowledge of the shipment of the merchandise or, failing that, from the reception of the same.
The return costs derived from the exercise of the right of withdrawal, will be borne by the buyer.
The exercise of the right of withdrawal on personalized items, or sealed items that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery will not be admitted

If you have not yet received the order and wish to cancel or modify it, you only have to inform us of the changes you want to make, without this implying any cost in the event that your order has not yet been processed.

Given the special characteristics of the products marketed by MIIJOYA on its website, there are slight differences between each product or service purchased, mainly due to the uniqueness and exclusivity of each and every one of the materials and stones used in its preparation, which is , in addition, largely artisanal. Therefore, no two MIIJOYA products or services are exactly the same and, in any case, it is inevitable that the product delivered to the customer differs slightly from that shown in the photographs included in the website purchase process (even if it had been the same) . In no case, these differences will imply the delivery of products or services with worse quality of materials than those expressly mentioned on the website. Likewise, the client is informed and is aware that the size of the photographs contained in the Portal does not correspond to the actual size of the MIIJOYA products offered as well as the range of colors offered in the articles may vary from that received mainly due to the differences in configuration and quality of the screens on which the website is displayed.
For this reason, the client is expressly informed and consents to these circumstances and differences, without them being grounds for termination of the Contract.

We will respond to the lack of conformity, of which the buyer must inform us within two months from when he became aware of it.

By regulations, and unless proven otherwise, it will be understood that the products are in accordance with the contract as long as they meet all the requirements expressed below:
- They conform to the description made and possess the qualities of the product that we have presented to the consumer and user in the form of a sample or model.
- They are suitable for the uses to which similar products are ordinarily destined.
- Present the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product.
